Illinois Attorney General Sues Online Retailer for Consumer Fraud
Illinois residents shouldn’t have to worry about being defrauded by businesses, especially when the economy hasn’t bounced back from the last five years of job cuts and losses.  When consumer fraud does occur, a private citizen can sue a defendant under Illinois’s Consumer Fraud and Deceptive Business Practices Act.  And in some cases, when enough consumers file complaints, the government can file a lawsuit against a fraudulent business owner or company.  That’s exactly what happened when Illinois Attorney General Lisa Madigan learned that an online auto parts retailer had been engaged in serious acts of consumer fraud since 2009.
Have you or a loved one been the victim of consumer fraud?  You may be able to file a claim for compensation.  It’s important to contact an experienced Illinois consumer lawyer as soon as possible.  At the Emerson Law Firm, we have been handling consumer fraud and consumer protection claims for years, and we can speak to you today about your case.
Details of the Alleged Consumer Fraud
According to the complaint filed by the Illinois Attorney General, Madigan’s lawsuit against Partz Now Inc. alleged that the online company defrauded customers out of at least $13,000 since opening its doors in 2009.  Alan Carter, the owner of the company, may end up being liable to thousands of consumers in Illinois and across the country.  Partz Now Inc., out of Bloomington, sold parts to customers throughout the U.S. states.
How did the online auto parts company defraud consumers?  In many cases, buyers never received their orders but were charged for the parts.  In other cases, consumers received the wrong part and were never refunded.
In response to the high number of customer complaints, Madigan wants the court to shut down Partz Now Inc. and to “prohibit Carter from selling auto parts,” according to a press release from the Illinois Attorney General’s Office.  The lawsuit also “seeks to cancel pending contracts with consumers, obtain restitution for affected consumers and impose civil penalties on the defendant.”
In the press release, Madigan emphasized the importance of doing your online shopping with a reliable vendor.  “Anyone can set up shop on the internet,” she explained.  Madigan continued, “that’s why it’s important to ensure you’re working with a reputable company.  Check to see if any complaints have been filed against the company with my office’s Consumer Fraud Bureau or the Better Business Bureau before making any significant purchases.”
What should you do if you have been defrauded?  It’s important to know that you have rights as a consumer.
