What Documents do I Need to File for Bankruptcy?

When you are considering consumer bankruptcy, it is important to know that the processes for both Chapter 7 bankruptcy and Chapter 13 bankruptcy are complicated. As such, you should always work with an experienced Oak Park bankruptcy attorney throughout your case. At the same time, it is also a good idea to understand the process of filing for bankruptcy before you actually do it, as well as the documents you will need in order to be eligible for a discharge of your debts or to have the court approve your Chapter 13 repayment plan. The following is a checklist of all of the documents you will need to have in order to properly disclose income and assets, as well as to provide the bankruptcy court with the information it needs to move forward with your case.

Tax Returns
You will need to have copies of your tax returns in order to complete your Chapter 7 or Chapter 13 bankruptcy petition. If you are filing for Chapter 7 bankruptcy, you will need the last two years of tax returns. If you are filing for Chapter 13 bankruptcy, you will need the last four years of tax returns.

Income Documentation
You will be required to provide at least six months of paycheck stubs and W-2s, and you made need to provide additional income documentation depending on your particular circumstances.

Motor Vehicle Registration and Related Information
Motor vehicle registration information, as well as valuation of your vehicle, will be necessary for your bankruptcy petition.

Bank Account Statements
In addition to bank statements for checking accounts and savings accounts, you will also need to provide retirement accounts (such as 401(k) accounts or 403(b) accounts) as well as any other accounts you currently hold.

Proof of Real Estate Holdings and Their Value
When you file for bankruptcy, you must provide proof of any real estate holdings (such as your home) and recent valuations of the property or properties.

Credit Card Statements (and Other Bills)
In addition to assets you have, you will need to provide clear documentation concerning your debts. You should have all credit card statements and other bills for debts that you plan to discharge or restructure readily available.

Proof That You Have Completed Credit Counseling
You will need to provide proof of completing a credit counseling class—you should get a certificate once you have completed this bankruptcy requirement.

Identification Materials
You will need to provide documentation that proves your identity. You should have at least your driver’s license and Social Security card available, along with other forms of identity documentation.
